Refund Policy

This Policy (the ‘Refund Policy’) sets out the practice of The Book Adviser in relation to refunds and cancellations. Generally, subject to law (including statutory obligations) or the ‘Special Refund Circumstances’ set out below, payments for access to the support, advice, templates and tips that comprise each of the 8 steps of The Book Adviser’s 12 month Book Coaching Program (the ‘Services’) are non-refundable for change of mind.

Legislative rights and obligations

Nothing in this Refund Policy limits (or is intended to limit) any consumer rights, or The Book Adviser’s obligations, under legislation, including the Australian Consumer Law (as set out in Schedule 2 of the Competition and Consumer Act 2010).

Payment terms

In order to access the Services, you must first purchase a subscription (the ‘Subscription’) and pay the applicable fee for the selected Subscription (the ‘Subscription Fee’). When you purchase a Subscription, you will be required to register for an account (the ‘Account’) through www.thebookadviser.com.au (the ‘Website’) before you can access the Services. Once you have completed the registration process, you will be a registered member of the Website (‘Member’).

The Book Adviser generally requires that Members make one up-front payment of the Subscription Fee, to be made before access to the Services begins. Once the Subscription Fee is paid, the Services will be made available to you over a consecutive 12 month period (the ‘Subscription Period’). This 12 month Subscription Period will commence on a date to be advised by The Book Adviser.

In certain limited circumstances, The Book Adviser may agree for two split payments of the Subscription Fee to be made over the Subscription Period: one payment to be made before access to the Services; and another after the first full three month period of access to the Services is complete. This will only occur with prior agreement with The Book Adviser and in very limited circumstances (such as on compassionate grounds).

Refunds or cancellation

If you have paid a Subscription Fee, then the Subscription Fee is non-refundable, except as subject to Australian Consumer Law and/or under the Special Refund Circumstances outlined in this Refund Policy.

If The Book Adviser has agreed for you to pay your Subscription Fee in two split payments (see ‘Payment terms’) and you wish to cancel before payment of the second payment instalment, the Subscription Fee for the first three months is non-refundable, except as subject to Australian Consumer Law and/or under the Special Refund Circumstances.

Special Refund Circumstances

In limited situations, and subject to law, you may be provided with a refund of the Subscription Fee where Special Refund Circumstances apply. These Special Refund Circumstances may include, but are not limited to, compassionate grounds such as serious illness or injury.

Subject to law, if you are eligible for a refund of the Subscription Fee due to Special Refund Circumstances, your refund may be calculated on the proportional amount of the Subscription Fee that remains unused. Please note that you may be required to provide evidence of your Special Refund Circumstances.

Deferral of the Subscription

In certain cases (and subject to law), the Subscription may be deferred. This may be to avoid circumstances beyond the Member’s control (including compassionate grounds) which impact on the Member’s ability to commit to all of the 8 steps of the Book Adviser’s 12 month Book Coaching Program over a consecutive 12 month period. Where this occurs, the Subscription, and access to the Services, may be temporarily cancelled and reactivated at a date to be agreed by The Book Adviser. Where a Subscription has been deferred, the full period of access to the Services will be 12 months.
